COLD FRONT COFFEE CLUB TERMS AND CONDITIONS
CONSUMER’S RIGHT TO CANCELLATION: YOU MAY CANCEL THIS CONTRACT WITHOUT ANY PENALTY OR FURTHER OBLIGATION AT ANY TIME. Notice of cancellation shall be provided by Buyer via a cancellation form in person at Cold Front, 490 Hamline Avenue South, St. Paul, MN 55116 or via email at coldfrontcoffeeclub@gmail.com. All monies paid pursuant to such cancellation shall NOT be refunded. The membership will be extended to the Buyer until the day prior to the following scheduled recurring payment date. If written notice must be received more than 14 days prior to the schedule recurring payment date, no additional charges will be posted to the Buyer’s card.
DEFINITION OF TERMS: A month of membership is considered the date of the start month to the day preceding the date of the following month – for example, a month of membership starts from April 3-May 2. The automatic billing date would fall on May 3 for the payment for the second month of membership.
ENTITLEMENTS OF MEMBERSHIP: The Cold Front Coffee Card entitles the buyer to unlimited regular sized hot coffee drinks including our Drip, Pour Over, Cappuccino, Latte, Espresso, Macchiato, Americano, Hot Chocolate, and our Brewed Tea offerings using whole, skim or soy milk where applicable). This offer excludes Chai Lattes, Hot Drinks listed on our Specials Menu, and any other items (including but not limited to vanilla or chocolate flavoring, or any other hot drink additions). All additional items excluded from this offer will be charged at the listed price. Beverages must be ordered and consumed one drink at a time.
RULES, REGULATIONS AND SCHEDULES: Member agrees to abide by all staff requests and regulations, which may be posted or issued orally, and which may be amended from time to time at Cold Front’s sole discretion.
PROOF OF MEMBERSHIP: No one will be allowed membership benefits without providing identification indicating a matching membership account.
GUESTS: Member’s guests are permitted and welcomed at Cold Front as in the general public, but only pursuant to such rules, regulations, fees, and schedules for such guest as may then be in effect. Services, discounts, and other promotions implied by purchase of the membership does not entitle guests of Members to such membership entitlements.
TRANSFERS OF MEMBERSHIP: Memberships may not be transferred.
BUYER’S OBLIGATIONS: No deduction from any payments shall be made because of Member’s failure to use the entitlement. Member dues are for the period of time indicated and are in no way related to actual usage of the benefits.
ENTIRE AGREEMENT: Except for the rules, regulations, and schedules posted at Cold Front’s website or issued orally by Cold Front from time to time at its discretion, all of which are incorporated into this agreement, this contract constitutes the entire and exclusive agreement between the parties related to the subject matter hereto and supersedes any or oral or other written understanding.
RECURRING PAYMENT SCHEDULE VIA PAYPAL: Member’s credit cards used for joining will be charged via PayPal on a recurring basis each month, one (1) month following their past payment made. If any credit card charge payable to Cold Front is not honored, Cold Front will terminate the account.
PRICING: Cold Front reserves the right to increase the monthly fee and will provide 30 days notice to all Members regarding any such change in pricing.
REVOCATION OF MEMBERSHIP: Cold Front reserves the right to revoke and cancel this membership at any time for any reason, in which case Buyer/Member will, no later than fifteen (15) days after such cancellation, receive a refund of all monies paid pursuant to this Agreement, provided that Seller may retain expenses incurred or the portion of the total price of this Agreement representing the services used or completed, and provided further, that Seller may demand the reasonable cost of goods and services which the Buyer/Member has consumed or wishes to retain after cancellation.
LIMITATIONS TO MEMBERSHIP: Cold Front and all staff reserves the right to limit use of the membership if they determine abuse of benefits offered. Each membership provides beverages for one (1) individual only. Members must be 18 years or older in accordance with Minnesota law.
MOBILE TELEPHONE NUMBER: Cold Front will retain the Buyer’s mobile phone information to tie the Coffee Club account to the buyer. This telephone number will also be shared with Appcard, Inc., who assists in administering the Cold Front Coffee Club program. The Buyer may elect to opt out of receiving promotional text messages that are sent to the Buyer’s mobile phone by following the “opt out” directions in the received text message or by editing the Buyer’s account.
CANCELLATION ONLINE: Members who signed up via PayPal must cancel their membership via PayPal by accessing member’s PayPal account online or via calling PayPal at 1-888-221-1161 (6AM-11PM Monday – Friday and 8AM-10PM CST Saturday and Sunday). Cancellations must also fill out a cancellation form at Cold Front. Members must cancel 14 or more days before the monthly renewal date in order to not get charged for the following month.
WAIVER OF LIABILITY: Member assumes full responsibility for his or her use of the facility and releases Cold Front from any and all claims, including those caused in whole or in part, by the negligence of Cold Front and shall indemnify Cold Front, its affiliates, agents and employees against any and all liability arising out of the use of the facilities.
